Bitara takes all necessary measures to protect the User’s privacy, in compliance with current legislation. Bitara will not sell or rent the User’s personal information to third parties, nor will it use or share it in a manner other than that described in this Privacy Policy, without the User’s prior consent.

Data collection, use and storage

Data collection: Cookies.

In order to offer the best browsing experience to the User, Bitara uses technologies to collect and store information related to the User’s visit to the Website and this may include sending one or more cookies or anonymous identifiers that collect data related to the User’s browsing preferences and the pages visited by the User. In this way, the Website presentation is personalized and aligned with the User’s personal interests. The use of this data is restricted to the indicated purpose and Bitara undertakes not to use or allow the use of such data for any other purpose. Use of data: E-mail

Bitara will use the User’s e-mail primarily to send information about its Business (confirmation of Transactions and status updates). The registered e-mail will also be used to recover the access password, in case of loss or forgetfulness of the password.

Use of data: Advertising via direct mail, e-mail, MMS or SMS

When registering their contact details, the User will be accepting the sending of advertising messages. Furthermore, at any time, the User may change their decision by contacting Bitara’s Customer Service or, alternatively, in the unsubscribe field in the Newsletters sent by Bitara, in which case the unsubscription from the database may take up to 5 (five) days to be effective.

Use of data: Other forms

In addition to the forms set out above, Bitara may, at its sole discretion, use the User’s personal data in the following ways:

(i) updating the registration;

(ii) ensuring the User’s security;

(iii) responding to requests from the User;

(iv) providing information about changes to the Terms and Conditions of Use or Policies;

(v) preparing statistics regarding the use of the Website, ensuring the User’s anonymity, including for the purpose of improving and understanding the User’s profile in order to improve the Website;

(viii) defending Bitara’s rights against the User in legal or administrative proceedings.

Data storage. Bitara will store all collected data in its protected and secure databases. Such data will only be accessed by automated computerized processes, authorized professionals and in the cases listed in this Policy.

If the User requests the deletion of their data from the database, Bitara reserves the right to keep the data in question in backup copies for up to 6 (six) months, in order to comply with legal obligations of mandatory storage.

Sharing and disclosure of data

Bitara prioritizes the confidentiality of the User’s personal data in its business. Therefore, it undertakes not to disclose, share, provide access to, facilitate access to, rent, sell, exchange or in any other way make such information available to third parties, under any pretext, except in cases expressly authorized by the User, including in the cases indicated below.

 

For the sole purpose of enabling the completion of Negotiation on the Website, Bitara may share Users’ personal data with its business partners, such as payment processing companies, credit card administrators and carriers. Bitara requests that Users not send Bitara any commercial information, personal creations, ideas, photographs, projects, concepts, etc. (Unsolicited Content). Such Unsolicited Content will be summarily discarded, without any reading or incorporation into Bitara’s databases. Under the terms of the Copyright Law, ideas, abstract concepts, projects, plans and schemes are not subject to protection in Brazil. Therefore, any use by Bitara of any Unsolicited Content will be the result of internal and independent development and may occur freely, with no authorization or compensation being due or required from the user or consumer. Bitara develops all of its policies and activities independently, and hereby rejects any accusation or allegation of use of Unsolicited Content.

Security measures

Technological resources

Bitara adopts advanced technological resources to ensure the security of all personal data collected and stored. Not even Bitara employees have free access to the Users’ database, which is limited to those whose functions require contact with personal data. Among the security measures implemented are the use of modern forms of encryption and the installation of barriers against unauthorized access to the database (Firewalls). These measures can be verified by the User by accessing the Website and viewing the “security padlock” in their internet browser.

Password confidentiality

Bitara recommends that the User keep his/her password completely confidential, avoiding disclosing it to third parties. The User should log out of the website and close the browser window when concluding a session. This is a preventive measure to prevent irregular and improper browsing by third parties not authorized to use his/her password. It is important to note that the User is solely responsible for maintaining the confidentiality of his/her password, and must be careful and responsible whenever browsing online. Bitara will never ask the User to provide his/her password outside the Website, by telephone, email or any other means of communication. The User’s password should be used exclusively when accessing the User’s Account on the Website. If the User suspects that his/her password has been exposed to third parties, Bitara recommends that the password be changed immediately.

Suspicious emails

Bitara only sends the User emails with advertising messages, advertising services or updating information. Bitara does not send messages

(i) requesting the User’s personal data;

(ii) requesting the User’s password or financial data;

(iii) with attached files except PDF or JPG documents;

(iv) with links to download files. If you receive an email with such characteristics, disregard it and contact Bitara by phone.

Credit cards

Bitara does not store the User’s financial information, such as credit card information, in its database. The payment approval procedure takes place between the User, the banks and the card administrators, without any intervention by Bitara.

No liability

Despite Bitara’s best efforts, the current state of technology does not allow for the creation of a database that is absolutely secure against attacks. Therefore, Bitara is exempt from any liability for damages eventually caused by third parties, including invasions of the Website or database, viruses or information leaks, unless Bitara’s exclusive fault is proven.

The user acknowledges and agrees that Bitara’s collection and use of the information provided by him/her as set forth in this Privacy Policy does not constitute any violation of the right to privacy and confidentiality, copyright, publicity or any other right related to the protection of personal information. However, the user is aware that privacy rights are independent of and should not be confused with intellectual property rights, image rights, rights to honor and reputation and other personality rights, and that, therefore, the information provided to Bitara will not always be protected.

Individuals’ rights regarding collected data

Bitara allows the User to register in different ways, containing more or less information according to their own purpose on the Website. Thus, the User has the possibility of choosing the form of registration, and must fill it out with truthful and updated information. The User declares to be the legitimate owner of their personal data and may, at any time, use the Website’s tools to edit, update or preventively remove them from our database. Bitara will keep the data preventively removed confidential for a period of 6 (six) months, in order to comply with legal obligations of mandatory storage, definitively discarding them after such period.
